Article 1 β Applicability
These terms and conditions apply to all quotes, assignments and agreements between Painting Company and the client, unless the parties have agreed otherwise in writing.
Article 2 β Quotes
Quotes from Painting Company are non-binding and based on the information available, and where possible, a site visit carried out at the time of quoting. If it becomes apparent during execution that the situation differs from what was established during the site visit (for example, hidden wood rot or damage that only becomes visible after removing old paint), we discuss this with the client before any additional work is carried out or additional costs are charged.
Article 3 β Formation of the agreement
An agreement is formed as soon as the client accepts a quote from Painting Company in writing (including by email), or as soon as Painting Company has started work on the client's instructions.
Article 4 β Execution of the work
Painting Company carries out the agreed work professionally and keeps the client informed of the planning. For exterior painting work, the schedule partly depends on weather conditions; in unsuitable weather (such as frost, rain or excessive humidity) execution may be postponed to ensure a durable result.
Article 5 β Prices and additional work
Prices in a quote include the work and materials stated in it. Work that is not included in the quote is only carried out and charged as additional work after consultation with, and prior agreement from, the client.
Article 6 β Payment
Invoices from Painting Company must be paid within the payment term stated on the invoice, or failing that, within 14 days of the invoice date. For larger projects, payment in instalments may be agreed in the quote.
Article 7 β Warranty
Painting Company stands behind the quality of the work carried out and the materials used. Any warranty periods on specific work are stated in the quote where applicable. The warranty lapses in the event of damage resulting from normal wear and tear, deferred maintenance after completion, or work carried out by third parties on the painted surface.
Article 8 β Liability
Painting Company is liable for damage that is the direct result of attributable shortcomings in the execution of the agreed work, up to a maximum of the invoice amount of the relevant assignment, unless there is intent or gross negligence. Painting Company is not liable for consequential damage or damage arising because the client provided incorrect or incomplete information about the condition of the property.
Article 9 β Force majeure
In the event of force majeure β including extreme weather conditions, illness of personnel carrying out the work, or delays at suppliers β Painting Company has the right to suspend execution of the work for the duration of the force majeure situation, without being liable for any compensation as a result.
Article 10 β Complaints
Complaints about the work carried out must be reported to Painting Company in writing as soon as possible, and no later than 14 days after completion, so that we can assess and, if necessary, resolve them.
Article 11 β Applicable law and disputes
Dutch law applies to all agreements with Painting Company. Disputes will first be resolved through mutual consultation; if the parties do not reach an agreement, the competent court in the Netherlands has jurisdiction over the dispute.
